Terms of Service

These Terms of Service ("Terms") govern your use of the VINHistoryNow website at vinhistorynow.com and related services (the "Service"). By creating an account, starting a subscription or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and able to enter a binding contract to use the Service.

The Service is operated by VIN HISTORY NOW LLC, a Mississippi limited liability company, 118 Seville Way, Madison, MS 39110, United States ("we," "us," "our"). Contact: support@vinhistorynow.com.

VINHistoryNow provides access to vehicle-history information compiled from available third-party data sources. Depending on the vehicle and data provider, reports may include:

• Accident and damage history
• Title and salvage records
• Odometer readings
• Ownership information
• Theft and lien information
• Service and maintenance records

Not every category is available for every vehicle. Record availability depends on what has been reported to our data providers.

Owner review: Confirm that the report provider actually supplies each category listed above, and the name of that provider, before publication.

You agree to provide accurate, current information, keep your login credentials confidential and notify us promptly of any unauthorized use. You are responsible for activity under your account.

You agree not to:

• Use the Service for any unlawful purpose, including any purpose prohibited by the Driver's Privacy Protection Act (DPPA) or other applicable privacy laws;
• Resell, redistribute or commercially republish reports without our written permission;
• Scrape, crawl or use automated means to access the Service beyond normal personal use;
• Use reports to make decisions about credit, employment, insurance or tenancy eligibility. VINHistoryNow is not a consumer reporting agency, and reports are not consumer reports under the Fair Credit Reporting Act;
• Interfere with or attempt to gain unauthorized access to the Service or its systems.

Reports are compiled from third-party sources, which may include the National Motor Vehicle Title Information System (NMVTIS). We do not create the underlying records and cannot verify that they are complete or correct.

• Not every accident is reported. Many accidents, repairs and damage events are never reported to any database.
• Available records may be incomplete, delayed or outdated.
• A clean report does not guarantee that a vehicle is free of problems.
• You should always obtain an independent inspection by a qualified mechanic before buying a used vehicle.

The Smart Buyer Vehicle History Bundle (one vehicle history report, a negotiation guide and an inspection checklist for one vehicle) costs $19.99 as a one-time payment. At checkout you may add a second VIN report credit for $9.99, also a one-time charge. Prices are in U.S. dollars and exclude any applicable taxes. Payments are processed by a third-party payment processor.

Purchases are not subscriptions. You will not be charged again unless you place a new order.

If you are not satisfied with your purchase, email support@vinhistorynow.com within 30 days of purchase and we will refund the full amount paid.

Nothing in these Terms limits any refund or remedy required by applicable law, or your rights regarding billing errors or unauthorized charges. See our Refund Policy.

The Service, including its software, design, text and logos, is owned by VIN HISTORY NOW LLC or its licensors. We grant you a limited, non-exclusive, non-transferable license to view and print reports for your personal, non-commercial use. Third-party data remains the property of its respective providers.

We aim to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, provider outages or events outside our control. Some data sources may change or become unavailable over time.

To the fullest extent permitted by law, the Service and all reports are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

To the fullest extent permitted by law, VIN HISTORY NOW LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for losses arising from your purchase or non-purchase of a vehicle based on a report. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so these may not apply to you.

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law rules. Before filing a claim, please contact us at support@vinhistorynow.com so we can try to resolve the issue informally. Any dispute that is not resolved informally will be heard in the state or federal courts located in Madison County, Mississippi, unless applicable consumer protection law entitles you to bring a claim where you live. Nothing in these Terms limits mandatory consumer rights.

Owner review: Decide with your attorney whether to add an arbitration clause or class-action waiver. None is included in this draft.

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, notify active subscribers by email before they take effect. Price changes will not apply to your subscription until you have been notified and given the chance to cancel.
